Terms of Service

These Terms of Service, together with our Privacy Policy (collectively, the “Terms”), are a binding agreement between you and Hot Shots Enterprises LLC, doing business as Hot Shots Batting Cages (“Hot Shots,” “we,” “us”), governing your use of our website, online accounts, camp registration, pitching-machine credits, and related services (the “Services”). By creating an account or using the Services, you accept these Terms. If you do not agree, do not use the Services.

1. Eligibility & accounts

You must be at least 18 years old to create an account. A parent or legal guardian must register and manage participation for any minor. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.

2. Purchases, credits, camps & payments

  • Pricing. Prices, packages, and availability are as shown at the time of purchase and may change. Applicable sales tax is added where required.
  • Payments. Card payments are processed by Stripe; by paying, you authorize the charge for your order. You represent that you are authorized to use the payment method.
  • Pitching-machine credits. Credits are redeemable at our facility for the associated machine time and may be subject to expiration as stated at purchase.
  • Camps. Registration reserves a capacity-limited spot and is confirmed on successful payment. Camp participation requires a completed, accepted waiver.
  • Discounts & promotions. Discount codes and promotional offers are subject to their stated terms and may be limited, changed, or withdrawn at any time.
  • Refunds. Refunds are handled by Hot Shots according to our then-current policies; some items may be non-refundable as noted at purchase. To request a refund or a change, contact us.

3. Waivers & assumption of risk

Use of a batting cage, pitching machines, and participation in camps and athletic activities involves inherent risks of injury. Participation requires acceptance of our separate liability waiver and release. These Terms do not replace, and are in addition to, any waiver, release, or assumption-of-risk agreement you sign with us. You agree to follow all posted rules and staff instructions while at our facility.

4. Acceptable use

You agree not to misuse the Services, including: attempting to gain unauthorized access; interfering with or disrupting the Services; using the Services for any unlawful purpose; submitting false information; or infringing the rights of others. We may suspend or terminate access for conduct that violates these Terms or harms Hot Shots, our customers, or others.

5. Intellectual property

The Services, including our name, logo, text, graphics, and software, are owned by Hot Shots or our licensors and are protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended personal, non-commercial purpose. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Services except as permitted by law.

6. Third-party services

The Services rely on third-party providers (including Stripe for payments and Intuit QuickBooks for our accounting). Your use of features powered by these providers may also be subject to their terms. We are not responsible for third-party services we do not control.

7. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, Hot Shots and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid to us for the transaction giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not affect the terms of any separate waiver or release regarding physical activities at our facility.

9. Indemnification

You agree to indemnify and hold harmless Hot Shots from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of- laws rules. You agree that the state and federal courts located in Washtenaw County, Michigan will have exclusive jurisdiction over any dispute not otherwise subject to a separate agreement.

11. Changes & contact
